Lecture on Sports Arbitration and European Competition Law in the Master in EU Law of the University Carlos III of Madrid
We have given a lecture on the interplay between sports and EU competition law, which has come to the fore over the past months as it has been at the core of various judicial proceedings that have required the intervention of the Court of Justice of the EU through its preliminary ruling mechanism
Our partner José Páez has delivered a session focusing on sports arbitration and competition law at the Master in EU Law of Carlos III University of Madrid.
The session has revolved around two main topics: the application of EU and competition law to sports; and the cases with EU competition law elements brought before the Court of Arbitration for Sport.
In addition, the discussion with the students also addressed the options available to CAS in the face of the findings of the ECJ in the International Skating Union case (C-124/21). In ISU, the ECJ found that the lack of review of compliance with public order, from a EU competition law standpoint, by the Swiss tribunal hearing an action for annulment against a CAS award fails to ensure that individual (competition law related) rights under the TFEU are upheld.
